Affecting Temporary Workers Working through Agencies and Umbrella Companies 


There are changes to the recruitment industry with effect from April 6 2016  that may affect the ability of Temporary Workers to claim Travel & Subsistence expenses.

 A briefing for Temporary Workers has been prepared by the Recruitment and Employment Confederation ( REC), which we hope will help you understand what the changes are and why they have been brought about. Click here to view.

 From April 6 2016, temporary workers working under ( or subject to the right of) Supervision, Direction or Control (SDC) will no longer be able to claim travel and subsistence expenses relief. HMRC has taken the stance that SDC applies UNLESS the agency or their client can prove otherwise.

 Therefore in order for us to correctly, determine the SDC status of our Temporary Workers, in compliance with the legislation, we will be asking our clients (as it is their responsibility to determine your status) to provide us with the necessary SDC information about the work you are currently or may be in the future carrying out on their site for each assignment/project that you work on. Please note that your SDC status may change with each Assignment/ Project.

Please note this is a government statutory piece of legislation and we are obliged to implement the rules which, if SDC applies to you, will most likely result in a lower take home pay,  depending on how much in expenses you were previously claiming each week .
